On many occasions, a divorce will have a life-long impact on the lives of you and your family. It will be one of the most emotionally draining times of your life and the ups and downs can affect your ability to think clearly and make rational decisions on issues that will directly impact your future. A divorce requires some very tough decision-making on matters such as child support, spousal support, custody, visitation, and distribution of marital assets and debts. Along with all the changes that are coming to your life, you are constantly worried about issues involving health insurance.

Many people are unaware that they might be entitled to keep their medical insurance benefits under their former spouse’s group plan. The Consolidated Omnibus Budget Reconciliation Act of 1985 created what are commonly referred to as COBRA benefits, which are available to former spouses of individuals who work for employers with 20 or more employees. In general, this law requires employers to offer a continuation of coverage for the first three years after a divorce.

To obtain COBRA benefits, you must file your application with your spouse’s employer no later than 60 days after the termination of your marriage. If you miss that deadline, you will not be able to receive benefits. If you are planning to file a divorce, or just got your divorce decree signed, you should consider looking into getting the COBRA benefits under your former spouse’s health insurance.
